OAMI 2075 - International Migration and Justice in the EU
This Course provides a critical overview of the origins and main legal and policy developments characterizing migration, borders and asylum policies in the European Union (EU) in light of justice and fundamental rights.
During the last decades the EU has created a common internal space of free movement (Schengen system) and a common Union citizenship. The abolition of internal border checks has come along the establishment of a common EU external border system and a set of security measures. What has been the progress in EU migration policy making both internally as well as in cooperation with third countries? What are the challenges and unfinished elements characterizing Europeanisation in these domains?
The course examines the relationship between EU migration policy and justice. What are the characteristics and implications of EU migration policies from the perspective of justice and fundamental rights? Special attention is paid to the scope and meaning of ‘Justice'. What is the scope and meaning of ‘Justice' in the EU, and its relevance or significance for migration policies and third country nationals?
A key ingredient under the notion of justice in the EU legal system is that of human dignity and access to effective remedies in light of alleged fundamental rights violations in the context of migration management. The following questions are examined: Are individuals labelled as migrants, asylum seekers or refugees beneficiaries of justice the EU? What are the effects of EU policies over their rights and liberties, and which rights are more sensitive or most affected as a result of EU migration, border and asylum policies?
Various ‘crisis' have taken a special role in the shapes migration policy making and policy shaping in the EU. The so-called ‘European Humanitarian Refugee Crisis' of 2015, or the most recent Covid-19 pandemic are exemplary instances of the impacts that crisis politics have on migration policies. The Course examines these by paying particular attention to the role and effects of ‘crisis-labelling' on justice and fundamental rights of individuals on the move, and more generally the rule of law. The Course offers the necessary tools and skills for students to critically engage in policy relevance research on migration, asylum and borders.
