KDEC 5060 - Introduction to tort Law

The purpose of this introductory course on tort law is to examine the style and methods of reasoning in common law systems. Tort law is primarily about non-contractual actions for compensation for damage caused by wrongful acts. The seminar will cover the historical background of tort law within the common law tradition and the conceptual foundations of this area of the law. Basic principles associated with tort law will be examined, with a focus on how to read judgments and apply legal principles to different factual situations. The emphasis will be on English law, although the approach taken in the seminar will be comparative, with references to developments in other common law jurisdictions and to French law.

Students will be expected to study a range of doctrinal texts and cases for each weekly class with a view to participating in class discussions.
